By accessing and using the services provided by Diga Technologies PLC ("Company", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement.

If you do not agree to abide by the above, please do not use this service. These terms apply to all visitors, users, and others who access or use our services.

Diga Technologies provides:

• Custom web application development and design services
• Business dashboard and internal tool development
• Enterprise hardware solutions including servers and networking equipment
• Technical consultation and support services
• System integration and deployment services

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

You agree to:

• Provide accurate and complete information when requested
• Use our services only for lawful purposes
• Not interfere with or disrupt our services or servers
• Not attempt to gain unauthorized access to any part of our services
• Comply with all applicable local, state, national, and international laws
• Respect intellectual property rights of the Company and third parties

The service and its original content, features, and functionality are and will remain the exclusive property of Diga Technologies and its licensors. The service is protected by copyright, trademark, and other laws.

For custom development projects, intellectual property ownership will be specified in individual project agreements. Generally, upon full payment, clients receive ownership of custom-developed solutions, while Diga Technologies retains rights to underlying frameworks and methodologies.

Payment terms will be specified in individual project agreements or service contracts. Generally:

• Payment schedules are established based on project milestones
• Hardware purchases typically require 50% deposit with balance due on delivery
• Development projects may require upfront payments and milestone-based billing
• Late payments may incur additional charges as specified in service agreements
• All prices are subject to applicable taxes

While we strive to provide high-quality services, we provide our services "as is" and "as available" without warranties of any kind, either express or implied.

We do not warrant that:

• The services will meet your specific requirements
• The services will be uninterrupted, timely, secure, or error-free
• The results obtained from the use of services will be accurate or reliable
• Any errors in the services will be corrected

Hardware products are covered by manufacturer warranties. Software and development services include warranty periods as specified in individual agreements.

In no event shall Diga Technologies, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability for any claim arising out of or relating to these terms or our services shall not exceed the amount paid by you for the specific service giving rise to the claim during the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless Diga Technologies and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the service will cease immediately. If you wish to terminate your account, you may simply discontinue using the service.

These Terms shall be interpreted and governed by the laws of Ethiopia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.
